20. Una modesta proposta. Anzi due – A modest proposal. Or rather, two.
Dov’eravamo rimasti prima che la Francia, dalle sue banlieues, ci desse una così lezione definitiva di umanità su come si integra l’immigrazione?
Eravamo rimasti al Procuratore Nazionale Antimafia e Antiterrorismo, Gianni Melillo, che notificava al Ministro Carlo Nordio la sua professione di fede nelle intercettazioni come irrinunciabile strumento di giustizia. Il Procuratore infatti 1) non conosce intercettazioni inutili; 2) chiede “la più rapida messa in opera delle infrastrutture e dei sistemi informatici necessari” per intercettare sempre più e sempre meglio; 3) auspica che non vi siano arretramenti su questo versante.
Del resto, data la qualità media degli apparati dello Stato, perché costringere i suoi funzionari a usare il cervello quando basta usare le orecchie? Non ci rimetteremo mica a fare indagini come Montalbano, Maigret o Sherlock Holmes?
Onde aiutare il Procuratore a scongiurare il pericolo, ecco un paio di suggerimenti:
1) formalizzare con legge apposita l’istituto della delazione spontanea: torme di inquilini frustrati e di specialisti negli altrui affari darebbero un apporto determinante. Basta un formulario adeguato, facilmente staccabile da internet e, una volta compilato, inviabile a un femoposta elettronico che garantisca la privacy più totale del delatore nel compimento di questo suo dovere civico. Se poi aggiungiamo un sistema di punti-premio per ogni delazione, da utilizzare come sconto al supermercato sotto casa, le ricadute sull’efficacia della giustizia potrebbero essere inimmaginabili. Ma anche senza punti-premio, oltre la gloriosa Cortina di Ferro degli anni ruggenti, il sistema ha funzionato perfettamente per decenni.
2) Formalizzare con legge apposita l’istituto della delazione indotta: semplici ausili per indurre gli intercettati a parlare una volta nelle mani della giustizia, come il supplizio della goccia, lo stivaletto malese o il tratto di corda – al limite, anche l’ascolto forzoso dell’intero repertorio di Orietta Berti e Nicola di Capri.
Niente di troppo splatter, come lo squartamento, l’impalazione o la bollitura nell’olio, indubbiamente, ma perché privarsi della possibilità di raccogliere quantità insospettabili di informazioni – e proprio quelle che il funzionario preposto vuole sentirsi raccontare? Una sbirciatina ai programmi della Lubianka moscovita del bel tempo che fu, potrebbe essere d’aiuto nella stesura del testo legislativo.
Del resto, la gloriosa rivoluzione illuminista che, verso fine Settecento, ha spinto il mondo verso la modernità al grido di Liberté-Egalité-Fraternité, ha tagliato teste in congruo numero per evidenziare bene il concetto che lo Stato non è al servizio dei cittadini, ma sono i cittadini al servizio dello Stato – più precisamente: a disposizione dello Stato. Come si fa, dopo duecentotrent’anni, a non averlo ancora capito? Non vorremo ritornare all’ancien régime, vero?
Il Procuratore Nazionale ha opportunamente colto l’occasione per ribadire il concetto.
Ma non fermiamoci qui. Se i diritti del cittadino sono un problema per lo Stato, togliamoli di mezzo. Così potremo finalmente accontentare anche i relitti sopravvissuti al sessantottismo, realizzando la loro gloriosa abolizione del privato.

We were with the National Anti-Mafia and Anti-terrorism Prosecutor, Gianni Melillo, who notified Minister Carlo Nordio of his profession of faith in wiretapping as an indispensable instrument of justice. In fact, the Prosecutor 1) knows no useless wiretappings; 2) he asks for “the fastest implementation of the necessary infrastructures and information systems” to achieve more and better wiretappings; 3) he hopes that there will be no step back on this front.
After all, given the average quality of the State apparatus, why force its officials to use their brains when it is enough to use their ears? Would it be better to go back to investigating like Montalbano, Maigret or Sherlock Holmes?
To help the National Prosecutor avert the danger, a couple of suggestions here below:
1) formalize the institute of spontaneous tip-off with a specific law: hordes of frustrated tenants and specialists in other people’s affairs would make a decisive contribution. It is just needed an adequate form, easily detachable from the internet and, once completed, easily to be sent to an electronic mail box which guarantees the informer’s total privacy in the fulfillment of his civic duty. If we then add a system of reward points for each denunciation, to be used as a discount at the supermarket near home, the repercussions on the effectiveness of justice could be unimaginable. But even without reward points, beyond the glorious Iron Curtain of the Roaring Years, the system worked flawlessly for decades.
2) Formalize the institute of induced tip-off with a specific law: simple aids to induce the intercepted to speak once in the hands of justice, such as the punishment of the drop, the Malaysian boot or the stretch of rope – to the limit, even forced listening of the entire repertoire of songs of Orietta Berti and Nicola di Capri.
Nothing too splatter, such as quartering, impaling or boiling in oil, undoubtedly, but why deprive the State of the possibility of collecting unsuspected quantities of information – and precisely those that the official in charge wants to hear? A peek at the programs of the Moscow Lubianka of the good old days could help in drafting the legislative text.
After all, the glorious Enlightenment revolution which, at the end of the eighteenth century, pushed the world towards modernity to the cry of Liberté-Egalité-Fraternité, cut off a large number of heads to clearly highlight the concept that the State is not at the service of the citizens, but the citizens are at the service of the State – more precisely: at the disposal of the State. How can somebody, after two hundred and thirty years, still not understand it? Do we want to go back to the ancien régime?
The National Prosecutor appropriately took the opportunity to reiterate the concept.
But let’s not stop here. If the citizen’s rights are a problem for the State, let’s get rid of them. Thus we will finally be able to satisfy even the wrecks that survived the 1968 era, realizing their glorious abolition of the private.
